Most of Peru region opposes Newmont mine: poll

LIMA (Reuters) - A controversial $5 billion gold mine in northern Peru lacks the support of most people who would live near it, according to the first significant poll of local opinion about U.S-based Newmont Mining's Conga project.

The results from Ipsos, often regarded as the most respected polling firm in Peru, could further hobble the project, which is supported by the government but has been stalled by protests in the northern region of Cajamarca since last November.

Just 15 percent of 250 people polled in the province of Cajamarca favor the proposed mine, while 78 percent oppose it, a number that swells to 83 percent in rural areas, according to the Ipsos poll conducted between August 3 and 9.

"It's dead," Gregorio Santos, the left-wing president of the region of Cajamarca who has led rallies against the mine, said via twitter about the results. "I hope the prime minister addresses this."

The high-profile conflict has dominated President Ollanta Humala's first year in office, resulting in five deaths and two cabinet shuffles.

Locals fear the project, an expansion of the Yanacocha mine in Cajamarca, will cause contamination and ruin local water sources essential to their agricultural livelihoods. The company says reservoirs it would build will provide year-round water supplies in areas that currently suffer during the dry season.

The Conga mine would be one of the biggest investments in Peru's history. Mining makes up 60 percent of Peru's export earnings and has traditionally powered its economy, although towns near mines often are plagued by poverty.

The project has become a lightning rod for debates about whether mining can benefit local communities without damaging the environment, and whether national economic interests should trump local opposition to extractive activities.

Other polls have shown nationwide support for Conga. A separate Ipsos poll this month found that nationally, 45 percent of Peruvians support it, while 40 percent oppose it.

Some have advocated solving the dispute with a referendum in Cajamarca, which the government has rejected.

A two-day demonstration against Conga continued calmly in different parts of Cajamarca on Wednesday, including provinces covered by an ongoing ban on civil liberties.

Newmont, whose Chief Executive Richard O'Brien was in Peru last week, has said it will proceed with construction only if it has local and national support. Last month he said Conga "will occur only with local and national support ... Conga is still in our plans but moving ahead on a very measured basis."

Court allows 'show me your papers' laws in Alabama, Georgia

(Reuters) - A federal appeals court ruled on Monday that Alabama and Georgia could enforce key aspects of their laws against illegal immigration that allow police to check the status of criminal suspects.

The decisions were in line with the U.S. Supreme Court ruling on a similar Arizona law, but the U.S. Court of Appeals for the 11th Circuit in Atlanta continued to block other parts of the two Southern states' laws, which have been challenged by the federal government and civil rights groups.

Judges said the laws' opponents were likely to prevail in their fight against provisions in both states that would make it a crime in some cases to knowingly harbor or transport an illegal immigrant.

The court also barred Alabama from requiring schools to check the immigration status of children upon enrollment and from requiring all immigrants to carry a registration document at all times.

"We conclude that most of the challenged provisions cannot stand," the court said regarding the Obama administration's case against Alabama.

The rulings follow a split Supreme Court decision in June on Arizona's first-of-its-kind crackdown on people who are in the country illegally in which the court upheld a measure requiring police to check the immigration status of people they stop and suspect are in the country illegally.

But the top U.S. court struck down provisions requiring immigrants to always carry immigration papers, banning illegal immigrants from soliciting work in public places, and allowing police arrests of immigrants without warrants if officers believed they committed crimes that would make them deportable.

Other states that used Arizona's example in crafting immigrations laws have been waiting for rulings of their own in light of that decision.

The mixed opinions from the appeals court on Monday drew praise from both sides of the issue. The House speaker in Alabama said the court had upheld the "real teeth" of that state's law, while critics hailed the injunction against the schools provision.

"The essence of Alabama's immigration law has been upheld by today's ruling," Republican Governor Robert Bentley said in a statement. "The Court is recognizing the state's authority to inquire on immigration status in certain circumstances."

Opponents vowed to keep fighting what have been dubbed the "show me your papers" provisions, which they argue cannot be enforced without racial profiling.

"Alabamian children can now start the new school year without fear that their citizenship will be questioned, and Georgians can continue to give neighbors and friends a ride without first asking for their 'papers,'" said Marielena Hincapi?, executive director of the National Immigration Law Center.

Turkmenistan launches second political party

ASHGABAT (Reuters) - Turkmenistan launched its second political party on Tuesday, a token nod to democracy unlikely to pose any challenge to the absolute rule of President Kurbanguly Berdymukhamedov in the reclusive, gas-rich Central Asian state.

The 300-member Party of Industrialists and Entrepreneurs held its inaugural meeting two years after the president ordered the creation of a multi-party system in the ex-Soviet republic.

State media reported that Orazmammed Mammedov, a member of the Union of Industrialists and Entrepreneurs - which itself was signed into being by the president last year - was elected chairman of the new party.

Known as Arkadag, or The Patron, Berdymukhamedov is president, prime minister, commander of the armed forces and leader of the Democratic Party which, until now, was the only legally registered political force in Turkmenistan.

Analysts are skeptical that the 54-year-old qualified dentist plans to relax his tight grip on the desert nation of 5.5 million people bordering Iran and Afghanistan, which BP says holds the world's fourth-largest natural gas reserves.

Turkmen opposition activists live in exile and rights groups regularly rank the country among the world's most repressive. Human Rights Watch said in its latest annual report that media and religious freedoms were subject to "draconian restrictions."

Keen to win investment for the country's gas ambitions, Berdymukhamedov has taken steps to bring Turkmenistan out of the isolation that accompanied the eccentric rule of predecessor Saparmurat Niyazov, who banned opera and renamed the months of the year.

In his first public comments after winning re-election in February, Berdymukhamedov said he aimed to build a market economy and multi-party political system. He has also approved the creation of a third, agrarian party.

Berdymukhamedov extended his term by five years by winning 97 percent of votes in the February 12 election, which was shunned by the Organisation for Security and Cooperation in Europe because of its lack of competition.

Berdymukhamedov set himself up against seven token challengers drawn from government ministries and state enterprises, several of whom openly praised the president's achievements prior to the vote.
