German court's preliminary ruling says Samsung's Galaxy Tab 10.1N isn't aping the iPad

Round a few corners, a bit of nip-tuck and a tossed-on N. Oh, and probably just being sick and tired of the whole ordeal. We're assuming that's the recipe for getting the Cupertino-sourced gorilla off of Samsung's back, as a judge at the district court in Düsseldorf, Germany just issued a preliminary ruling that effectively clears the Galaxy Tab 10.1N from claims that it too mimics the iconic iPad. If you'll recall, the court blocked German sales of the original Tab 10.1 back in September, following Apple's arguments that Sammy's tab just looked too much like the iPad. Not surprisingly, the subtly-redesigned Tab 10.1N still drew fire from Apple's lawyers, but it's looking like they'll be riding home on the losing train this go 'round. A final verdict is expected on February 9th, of which we're sure you'll be resting uneasily on the edge of your seat to hear the result of. Courtroom fever -- catch it!

Adam Lambert on Arrest: Drunken Lesson Learned!


In a word: oops!

That is Adam Lambert's reaction to the brawl he and boyfriend Sauli Koskinen got into last night, as the pair were arrested and interrogated by Finnish police after SERIOUSLY getting into it around 4 a.m. outside a bar in Helsinki.

Russian drilling rig sinks off Sakhalin, 51 missing (Reuters)

MOSCOW (Reuters) ? An oil drilling rig with 67 crew on board capsized and sank off the Russian Far East island of Sakhalin when it ran into a storm while being towed, and 51 of the crew were unaccounted for, Russian news agencies reported on Sunday.

Fourteen crew members were rescued alive from the 'Kolskaya' jack-up rig, operated by Russian exploration company Arktikmorneftegazrazvedka, two bodies were recovered and the rest of the crew were missing.

"According to reports from the scene of the rescue operation, the Kolskaya platform has sunk completely," the local head of the Emergencies Ministry, Taimuraz Kasayev, told a news briefing in Yuzhno-Sakhalinsk.

Agencies quoted officials as saying the rig capsized at about 0200 GMT on Sunday around 200 km (125 miles) off the coast of Sakhalin as it was being towed from the eastern peninsula of Kamchatka.

It appeared that the vessel had not been doing drilling work, so no oil spill was likely. The rig's destination was not immediately clear.

While less serious that BP's Macondo disaster, when a blowout caused oil to spew for months into the Gulf of Mexico, the fatal accident will deal a blow to Russia's efforts to step up offshore oil and gas exploration.

Russia has two major offshore projects that are already producing oil off Sakhalin - Sakhalin-1, operated by Exxonmobil and Sakhalin-2, in which state-controlled gas export monopoly Gazprom has a controlling stake.

State-controlled Rosneft this year reached a major deal with Exxon to explore for oil and gas in the Arctic Kara Sea.

Comet survives fiery plunge through sun

A newfound comet defied long odds Thursday, surviving a suicidal dive through the sun's hellishly hot atmosphere, according to NASA scientists.

Comet Lovejoy plunged through the sun's corona at about 7 p.m. ET, coming within 87,000 miles of our star's surface. Temperatures in the corona can reach 2 million degrees Fahrenheit, so most researchers expected the icy wanderer to be completely destroyed.

But Lovejoy proved to be made of tough stuff. A video taken by NASA's Solar Dynamics Observatory spacecraft, or SDO, showed the icy object emerging from behind the sun and zipping back off into space.

"Breaking News! Lovejoy lives! The comet Lovejoy has survived its journey around the sun to reemerge on the other side," SDO researchers tweeted.

SDO is one of many instruments that scientists ? eager to record and study the comet's presumed demise ? trained on Lovejoy as it streaked toward the sun.

"We have here an exceptionally rare opportunity to observe the complete vaporization of a relatively large comet, and we have approximately 18 instruments on five different satellites that are trying to do just that," Karl Battams, a scientist at the Naval Research Laboratory in Washington, wrote on the Sungrazing Comets website before Lovejoy's closest solar approach.

Battams runs the website, which is devoted to comets discovered by two different spacecraft: NASA's Solar Terrestrial Relations Observatory (STEREO) and the Solar and Heliospheric Observatory (SOHO), which is operated jointly by NASA and the European Space Agency (ESA). Preparing for the end
Lovejoy has a core about 660 feet wide. It belongs to a class of comets known as Kreutz sungrazers, whose orbits bring them very close to the sun.

All Kreutz sungrazers are thought to be the remnants of a single giant comet that broke apart several centuries ago. They're named after the 19th-century German astronomer Heinrich Kreutz, who first showed that such comets are related.

Comets plunge into the sun on a regular basis, but they rarely give much advance notice of their suicidal intentions. That's why scientists were so excited about Lovejoy. Australian amateur astronomer Terry Lovejoy discovered the icy wanderer on Nov. 27, giving researchers plenty of time to map out their observation campaign.

And that campaign has been intense, involving five different spacecraft. In addition to SDO, SOHO and STEREO, scientists planned to use Japan's Hinode satellite and ESA's Proba spacecraft to track Lovejoy's movements, Battams wrote.

For his part, Terry Lovejoy said he was happy to have made a contribution, and he marveled a bit at all the attention the comet has been getting.

"It's been tremendous," Lovejoy told Space.com. "Apparently it's all over Facebook, and I don't use Facebook. But there's a lot of interest. I think a lot of people like the name ? the Lovejoy name seems to strike a chord with people."

A dramatic escape
Lovejoy is quite large for a sungrazing comet, and experts expected it to die an impressive death. The website Spaceweather.com, for example, predicted Lovejoy would blaze as brightly as Jupiter or Venus in the sky as it neared the sun.

Battams also expected a good show, saying the comet might even be visible from the ground around sunset today in the Northern Hemisphere.?

"I do think that it will put on a spectacular show for us and will be the brightest Kreutz-group comet that SOHO has ever observed," Battams wrote last week.

Though the early returns are just starting to come in, those forecasts appear to be on the money. Observations from various spacecraft do indeed show Lovejoy flaring up significantly as it neared our star.

Researchers will keep analyzing the images to better understand the comet's daring solar approach. And now skywatchers apparently have another shot to catch a glimpse of the resilient Lovejoy on Friday morning.

For observers in North America, the comet will rise approximately 5 to 10 minutes before dawn and will be situated to the upper right of the sun. If Lovejoy is still shining at least as brightly as Venus, it may be visible, experts say.?

You could also try to spot Lovejoy after the sun comes up, if you're exceedingly careful. Block the rising sun behind a distant building and focus on the part of the sky 3 to 4 degrees above and to the right of the sun (your clenched fist held at arm's length is equal to roughly 10 degrees).

CAUTION: Never point binoculars or a telescope at or near the sun, and never look directly at the sun with the naked eye. Serious eye damage can result.

And don't get your hopes up, either. The comet may well be too faint to see, experts say.

South Africa gallows site becomes museum, memorial (AP)

PRETORIA, South Africa ? Martha Mahlangu can't bear to visit the prison where her son, an anti-apartheid guerrilla, was hanged. But she says it's important that other South Africans see the gallows the government opened as a monument Thursday, and contemplate the example her son set.

"Solomon only thought of freedom, to free the black man," she said in an interview in her Pretoria home. "He never thought of himself, only about seeing the black man free."

The 87-year-old former maid's voice faltered when she tried speak about being invited to take part in a series of events this week at the gallows at Pretoria Central Prison. She sat on her porch in a neighborhood set aside for blacks under apartheid that today remains predominantly black and poor.

She said she was instead sending her eldest son and a nephew to Thursday's inauguration by President Jacob Zuma of the gallows and the death row block housing it as a national memorial and museum. She also sent her son and nephew to a traditional ceremony Wednesday during which relatives of those hanged offered prayers and burned incense in remembrance. Zuma toured the building Thursday morning at the start of the ceremony to open the site, accompanied by several Cabinet ministers and George Bizos, a prominent campaigner against the death penalty who was also former President Nelson Mandela's lawyer.

Death row was in a low, brick building with imposing oak doors just outside the main block of Pretoria Central Prison. The gallows were abandoned after the death penalty was abolished in 1995. Thursday, a sign on a freshly painted wall along a hallway leading to the gallows told visitors some 3,500 South Africans were hanged over the last century. "Of these," it said, "130 were patriots whose only crime was fighting oppression."

Not all those hanged were executed in Pretoria, but many of the most prominent were.

South Africa's highest court ruled in 1995 that the death penalty was a cruel, inhuman and degrading violation of the country's post-apartheid constitution. Executions had been on hold since 1989, as a debate raged that touched on the executions of anti-apartheid militants and on whether there could be a fair or just way of deciding who would be hanged.

Solomon Mahlangu was among the class of 1976, young South Africans radicalized by a student uprising in Soweto that year that was met by a brutal police crackdown. He was 20 when he left South Africa to train in Mozambique and Angola with Umkhonto we Sizwe, the armed wing of the African National Congress, which celebrates its 50th anniversary Friday.

One of Solomon Mahlangu's trio got away. Another, the only one accused of firing a gun, was so badly beaten in custody he was judged unfit to stand trial. Prosecutors did not dispute that Solomon Mahlangu never fired a gun, but he was convicted of sharing his comrade's deadly purpose. He was hanged on April 6, 1979. The next day, his mother was brought to Pretoria Central and shown her son's plain wooden coffin. She remembers thinking it looked very small.

The gallows was destroyed in a smelter after the death penalty was abolished. Visitors to the site will see a replica: Seven nooses dangling from iron loops over a trap door.

A prison employee who said he had been a death row guard helped ensure the new museum's details are correct, down to the thickness of the ropes. He refused to give his name, saying he feared reprisals from South Africans who might consider him a murderer. But he said he was just doing a job.

The guard said the political prisoners were disciplined, never struggling, sometimes singing anti-apartheid songs as they climbed the stairs.

David Kutumela, a 56-year-old anti-apartheid activist who like Solomon Mahlangu began his fight after the 1976 uprisings, helped campaign to create the gallows memorial. He and other activists visited the gallows often as it was transformed into a museum.

"Walking up those 52 steps, we all think, `It might have been us instead of Solomon,'" he said.

Kutumela said the museum is for South Africans as young as or younger than he and Solomon Mahlangu were when they became militants. He said he worries today's children "don't even understand how this freedom came about."

In another sign of how far South Africa has come, the top spokeswoman for the prison department is an ANC veteran who trained as a teenager in the same Angolan camp where Solomon Mahlangu became a guerrilla.

Sibongile Promise Khumalo has a hug for everyone she meets, including the white guards at Pretoria Central who once escorted ANC fighters to their deaths.

Khumalo said she embraced the museum project, speaking with the families of those hanged instead of delegating the emotional job.

"I cried with those people," Khumalo said. "We were reopening wounds for them."

She said the goal was to offer closure to the families, and to society a chance to confront the wounds of the past and then move on.

"I know South Africans are forgiving," she said. "We need to help each other carry out this journey of remembrance."

(AP) ? A commercial U.S. satellite company said it has captured a photo of China's first aircraft carrier in the Yellow Sea off the Chinese coast.

DigitalGlobe Inc. said Wednesday one of its satellites photographed the carrier Dec. 8. A DigitalGlobe analyst found the image Tuesday while searching through photos.

Stephen Wood, director of DigitalGlobe's analysis center, said he's confident the ship is the Chinese carrier because of the location and date of the photo. The carrier was on a sea trial at the time.

DigitalGlobe, based in Longmont, Colorado, sells satellite imagery and analysis to clients that include the U.S. military, emergency response agencies and private companies. DigitalGlobe has three orbiting satellites and a fourth is under construction.

The aircraft carrier has generated intense international interest because of what it might portend about China's intentions as a military power.

The former Soviet Union started building the carrier, which it called the Varyag, but never finished it. When the Soviet Union collapsed, it ended up in the hands of Ukraine, a former Soviet republic.

China bought the ship from Ukraine in 1998 and spent years refurbishing it. It had no engines, weaponry or navigation systems when China acquired it.

China has said the carrier is intended for research and training, which has led to speculation that it plans to build future copies.

China initially said little about its plans for the carrier but has been more open in recent years, said Bonnie S. Glaser, a China expert at the Center for Strategic and International Studies.

"It wasn't until the Chinese actually announced they were sending it out on a trial run they admitted, 'Yes, we are actually launching a carrier,'" she said.

China publicly announced two sea trials for the carrier that occurred this year, she said.

The carrier's progress is in line with the U.S. military's expectations, said Cmdr. Leslie Hull-Ryde, a Defense Department spokeswoman.

A Defense Department report to Congress this year said the carrier could become operationally available to the Chinese navy by the end of next year but without aircraft.

"From that point, it will take several additional years before the carrier has an operationally viable air group," Hull-Ryde said in an email.

She declined to comment on the DigitalGlobe photo, saying it was an intelligence matter.

Early Atom N2600 benchmark, can't cedar wood for the trails?

It goes without saying that benchmarking something pre-release requires a cavalcade of sodium-chloride, but our curiousity was piqued at the prospect of some Cedar Trail sneak-peeks. Netbook Live has been at it again, pitting a 1.6GHz Atom N2600-touting ASUS Eee PC X101CH, against machines sporting 1.66GHz Atom N570 (ASUS 1015PX) and 1.0 GHz AMD C-50 (ASUS 1015B and Tosh NB550D) chips. The initial reports suggest that the 32nm-based N2600 is a touch behind the N570 in general CPU terms, but forges confidently ahead when it comes to graphics. The C-50 showed mixed results in CPU tests, with the N2600 falling behind on graphics this time round. The take-away being if you need more CPU oomph go for the meatier 1.83 GHz N2800. Bank of China to step in as Saab part owner: source (Reuters)

STOCKHOLM (Reuters) ? Saab's Dutch owner and China's Zhejiang Youngman Lotus Automobile have agreed that the Bank of China, the nation's fourth-largest bank by market value, will come in as part owner of the ailing carmaker, according to a source familiar with the deal.

Under the new deal, the Bank of China will replace Chinese investor Pang Da Automobile Trade Co. Youngman and the Bank of China will own just under 50 percent of the company.

The move could help pave the way for an approval by General Motors, which still has preferential shares in Saab and rejected an earlier rescue plan. It said in November it would stop supplying components and technology if Youngman and Pang Da succeeded with their acquisition bid.

Saab has lurched from crisis to crisis in the past year. The company has not produced a car in months because of unpaid salaries and bills.

The new plan has been handed over to GM.

Saab was not immediately available to comment.

The company is currently under court protection from creditors in Sweden after unions representing Saab employees began proceedings to put it into bankruptcy over unpaid wages.

Pang Da operates auto dealerships in China while Youngman produces commercial vehicles, including buses and trucks, and sells cars under the Lotus brand.

GM operates in China in a partnership with state-run automaker SAIC Motor Corp Ltd.

PARIS (AP) ? Seeking to restore confidence in the euro, the leaders of France and Germany jointly have called for changes to the European Union treaty so that countries using the euro would face automatic penalties if budget deficits ran too high.

But not everyone on Wall Street was reassured that Europe would get control of its 2-year-old debt crisis.

Stock prices rose and borrowing costs for European governments dropped sharply in response to the changes proposed on Monday by French President Nikolas Sarkozy and German Chancellor Angela Merkel. But some of the optimism faded late in the day when Standard and Poor's threatened to cut its credit ratings on 15 eurozone countries, including the likes of Germany, France and Austria which have been considered Europe's safest government debt issuers.

The announcement came only hours after Sarkozy and Merkel revealed sweeping plans to change the EU treaty in an effort to keep tighter checks on overspending nations. The proposal is set to form the basis of discussions at a summit of EU leaders on Thursday and Friday that is expected to provide a blueprint for an exit from the crisis.

While the Franco-German plan would tie the 17-eurozone nations closer together, a tighter union would likely also result in heavier financial burdens for the region's stronger economies, which have already put up billions of euros to rescue Greece, Ireland and Portugal.

Analysts noted that the proposals did not foresee a clear roadmap on how to get the eurozone economies growing again and to reduce funding costs for struggling nations in the longterm.

"If this is all we get it's really very bad news for the future of the euro," said Simon Tilford, chief economist at London's Centre for European Reform.

Many analysts have called on the European Central Bank to intervene in debt markets to lower struggling countries' borrowing costs or the creation of eurobonds ? debt backed by all 17 euro countries.

The euro fell after the S&P announcement, trading down 0.1 percent at $1.339, and trading in futures on the S&P 500 and Dow Jones Industrial Average turned negative.

After the New York markets closed, S&P confirmed that it had placed 15 nations on notice for possible downgrades. Only two countries that use the euro weren't affected: Cyprus already had that designation and Greece already has ratings low enough to suggest that it's likely to default soon anyway.

France and Germany, the eurozone's two largest economies which currently both have an AAA-rating, quickly came out against the S&P move.

"Germany and France reaffirm that the proposals they made jointly today will reinforce the governance of the euro area in order to foster stability, competitiveness and growth," they said in a joint statement. "France and Germany, in full solidarity, confirm their determination to take all the necessary measures, in liaison with their partners and the European institutions to ensure the stability of the euro area."

Stocks had risen after the leaders of France and Germany called for a new treaty to impose greater fiscal discipline on European countries. Yields on Italian government bonds receded sharply after the new premier Mario Monti introduced sweeping austerity measures over the weekend. That suggests traders believe Italy is less likely to default.

Investors are hoping that the summit of European leaders on Thursday and Friday will produce concrete measures to prevent a messy breakup of the euro currency, which is shared by 17 nations. Markets have been jittery because of fears that the euro might disintegrate, causing a sharp recession in Europe that would spread through the world economy.

"Our wish is to go on a forced march toward re-establishing confidence in the eurozone," Sarkozy said at a news conference in Paris on Monday, with Merkel at his side. "We are conscious of the gravity of the situation and of the responsibility that rests on our shoulders."

EU treaty changes could take months, if not years, to implement and don't wipe away the mountains of government debt dragging down Europe's economy. But preliminary buy-in Friday from the 17 countries that use the euro could set the stage for further emergency aid from the European Central Bank, the International Monetary Fund or some combination.

"The onus is still on the ECB to print money to make huge loans or bond purchases and draw a line under the crisis," said Jennifer McKeown, senior European economist at Capital Economics. "Perhaps if other member states sign up to Merkel's and Sarkozy's proposals this week the (ECB) will step in."

Sarkozy pledged to have a revised EU treaty ready for signing by March. It would then need to be ratified in each country, which could mean lengthy parliamentary debates or national referendums in some cases.

"A lot depends on the specifics and how these are going to be framed by lawyers," said Piotr Maciej Kaczynski, an expert on EU constitutional issues at the Center for European Policy Studies in Brussels.

At the very least, it could take at least 18 months to ratify a new treaty once it has been signed by all heads of state, said Kaczynski. "That is a much longer timeline than what markets might want," he said.

Bond-market analysts said they remain skeptical of Europe's ability to prevent future profligacy. "If you say it strong enough and often enough maybe people will believe it," said Guy LeBas, chief fixed income strategist at Janney Montgomery Scott. "But I don't think the markets believe 'Merkozy' at this point."

EU governments reacted with caution.

No other EU leaders came out against the Franco-German proposals, but no strong statements in favor were immediately forthcoming. The reaction from Austrian Finance Minister Harald Waiglein was fairly typical: "There is nothing here that contradicts our position," although more details are needed, he said.

The modern EU is based on a set of treaties, dating as far back as the 1950s, when the project of consolidating the continent began. The treaties detail the rules that countries must follow and outline the mandates of institutions like the ECB. The most recent was the Lisbon Treaty, which was ratified in 2009, giving additional powers to the European Commission and European Parliament.

Sarkozy said he and Merkel would prefer that the treaty changes they're proposing be agreed to by all 27 members of the EU. But he left the door open to an agreement only among the 17 euro countries and anyone else "who wants to join us."

Sarkozy and Merkel discussed several broad changes for the EU treaty, but failed to provide much detail. The changes they outlined included:

? Introducing an automatic penalty for any government that allows its deficit to exceed 3 percent of GDP. A majority of nations would need to oppose automatic sanctions for a country to avoid them.

Governments are supposed to abide by the deficit limit under existing rules, but many, including France, have flouted it. Further, punishment only occurs after a majority of euro countries votes to impose them.

? Requiring countries to enshrine in law a promise to balance their budgets.

A key issue for the proposal's final approval will be how much flexibility countries can have to run temporary deficits during economic downturns.

? Pledging that any future bailouts would not require private bond investors to absorb a part of the costs, as was the case for the Greek bailout.

Germany had earlier insisted that Europe's permanent bailout fund would demand private investors take losses if a country in the future needs rescuing.

? Promising to not criticize or otherwise comment on the work of the ECB.

This is intended to ensure the bank's independence and its ability to act without pressure from European leaders.

Sarkozy said more details would be included in a letter sent Wednesday to European Council President Herman Van Rompuy.

After Sarkozy and Merkel spoke, stocks rose and borrowing rates for governments across Europe plunged, indicating a sharp rise in investor confidence in the continent's ability to resolve the crisis.

France's CAC-40 index climbed 1.2 percent, Germany's DAX rose 0.4 percent and markets outside of Europe also pushed higher, with the Dow Jones industrial average up 1.2 percent.

French banks, which have been hit hard this year over fears about their large exposure to the government bonds of financially weak countries like Greece, saw some of the biggest gains.

Societe Generale's stock price climbed 6.2 percent while BNP Paribas rose 4.9 percent. In Italy, shares of Unicredit rose 5.4 percent while Spain's Santander rose 3.6 percent.

Worries about the stability of the euro reached a fever pitch in recent weeks as the yields on Italy's bonds ? in a nutshell, its borrowing costs ? jumped above 7 percent. That is the level that eventually forced Greece, Ireland and Portugal to require bailouts. By comparison, bond yields in Germany, Europe's largest and most stable economy, are roughly 2 percent.

Italian and Spanish bond yields fell sharply on Monday, an indication of growing investor confidence in their financial future. The yield on Italy's benchmark 10-year bond fell from 6.65 percent to 5.93 percent.

Italy, whose government debt is equivalent to 120 percent of the country's annual economic output, needs to refinance $270 billion of its $2.6 trillion of outstanding debt by the end of April.

The size of the problems facing Italy and Spain are considered too large for the existing funds available to the European Financial Stability Facility ($590 billion) and the IMF ($389 billion.) To boost the firepower of the IMF, several economists have proposed that the ECB lend to it.

The big threat to the global financial system is that Europe's debt crisis could spiral out of control.

If governments default on their bonds, banks that own them could take a significant hit. It could become very difficult for these banks to borrow and nervous depositors could flee with their cash. In the worst case, a global financial panic could be triggered, in which banks all over are too skittish to lend to each other. That would cause a credit crunch that deprives businesses of the short-term financing they depend on for day-to-day operations.

With such fears in the air, the United States is ratcheting up its involvement.

U.S. Treasury Secretary Timothy Geithner Geithner will meet Tuesday in Germany with ECB President Mario Draghi and German Finance Minister Wolfgang Schauble. On Wednesday, he travels to France for talks with Sarkozy and the prime minister-elect of Spain, Mariano Rajoy Brey.

E!'s Giuliana Rancic to have double mastectomy

When Giuliana Rancic announced on TODAY in October that a mammogram revealed that she had the early stages of breast cancer, the E! News host received an outpouring of support. The scores of well wishes and prayers are in part what lead her to go public with the newest, more radical development in her treatment.

Rancic, who initially underwent a double lumpectomy, told Ann Curry on Monday, "I'm going to go ahead and move forward with a double mastectomy."

When Giuliana's husband, Bill, was last on TODAY, just after his wife's first procedure, the hope was that lab results would reveal all the cancer was removed during the lumpectomies. Bill, who was by his wife's side Monday morning, said ultimately, "in the one breast they weren't able to clear the margins and get all the cancer out. So we were then faced with a decision to make." Bill explained, "do you go back and do another lumpectomy, and try to clean it out or do you go for a more radical procedure?"

The decision to opt for that more radical procedure stemmed from several factors. Among them, wanting to have children. Giuliana, who is 37, told Curry that the anti-estrogen therapy involved with another lumpectomy and radiation could delay that process by years, but ultimately choosing the option that provided the best odds is what tipped the scales.

"In the end, all it came down to was just choosing to live and not looking over my shoulder for the rest of my life," Giuliana said.

Bill added, "This is a decision that wasn't made lightly. We talked to as many experts as we could, we got the best information that was made available to us. And one of the other factors that came in was quality of life. If she had chosen the lumpectomy and radiation, then you have to go in every six months for the rest of your life getting mammograms ... You're always looking over your shoulder. In this particular case, this was the best option for Giuliana."

"For me, it was very important to just get the cancer out," Giuliana said. "That's what I wanted to do. Just get it out. With the double mastectomy I have less than 1 percent chance of getting it (the cancer) back. With the lumpectomy, radiation and medication, I could have seen 20 to 30 to 40 percent chance in my lifetime, and for me it just wasn't worth it."

Although Giuliana was quite stoic and decisive during the interview, she made it clear this decision was not an easy one. "lt was a very hard decision to come to. But in the end what happened was, Bill said to me, 'I just need you around for the next 50 years, kid. I don't care what you look like, I don't care about the physical portion of this, I just need you around for the next 50 years. So let's just get you healthy.'"?

Speaking of Bill, Giuliana said his support has been essential to her personal and emotional survival. "Bill's been the world to me through this. I couldn't have done it without Bill?... I?couldn't be more at peace with the decision," Giulana said. "I still break down some nights. When it's quiet in bed, it's easy to start crying and just be sad. But I'm OK."

Today I went back to the treatment center I went to last year, to speak to the beautiful women fighting their inner demons. Was so honored to be able to share my story and let them know that it gets easier. Life is beautiful. You are worthy of it," she posted in a series of tweets.

(AP) ? A Texas parolee now linked to a deadly Craigslist robbery scheme was in an Ohio jail and poised to stay there but was released after Texas officials said they only wanted him extradited if he were convicted on a drug charge, according to court records and a sheriff's office.

Richard Beasley, released in July on a judge's order, is now linked to an autumn plot in which, authorities say, someone tried to lure robbery victims by posting a bogus ad touting a cattle farm job in southeast Ohio.

Authorities have connected two bodies and the shooting of a man who survived to the scheme, which targeted single, out-of-work men in their late 40s or early 50s. The investigators heading up the Craigslist inquiry also found a third body but have yet to link it to the case.

Texas issued a warrant in February when Beasley was arrested on drug charges and confirmed the existence of the warrant with Ohio officials in June when Beasley was arrested again on a separate drug-dealing charge. The Texas warrant asked that Beasley be held for violating parole on a burglary conviction there.

Beasley asked to be released on bond, and on July 12, Akron Municipal Judge John Murphy granted his request. "Texas authorities are only interested in extradition if there is a conviction in Ohio," Murphy wrote.

Texas says it never authorized Beasley's release and filed two additional warrants for his arrest after the Texas Parole Authority learned he'd been freed. Beasley was released "despite the existence of the Texas warrant and detainer," Jason Clark, a spokesman for the Texas Department of Criminal Justice, said Thursday.

"That doesn't say to me we were OK with him being free from custody," Clark said. "At no point did anyone from our agency, parole division, ask that that warrant be waived."

Bill Holland, a spokesman for the Summit Count Sheriff's Office, said Texas officials said they wanted to wait until the outcome of the Akron drug case, "because if he was found not guilty, then there would be no parole violation."

On Thursday, Beasley was wheeled into court in Akron on the drug charge, accusing him of illegally dealing prescription painkillers in November 2010. Beasley's head bobbed rhythmically, and he later ignored questions about the mounting body count and his relationship with a teen murder suspect.

Beasley, unshaved and dressed in a white and gray striped jail outfit, didn't speak and kept his head down as a Summit County Common Pleas judge revoked his bond on the drug-trafficking charge.

The legal problems faced by Beasley, a 52-year-old self-styled chaplain and youth mentor, are mounting: His attorney said a prostitution case involving Beasley and a 17-year-old boy would be upgraded with a racketeering charge Friday.

The drug and prostitution cases in Akron are unrelated to a widening Craigslist homicide investigation.

In that case, 16-year-old Brogan Rafferty, of nearby Stow, faces juvenile charges of aggravated murder, complicity to aggravated murder, attempted murder and complicity to attempted murder in the death of one man and the shooting of another.

The complaint against Rafferty says he participated in the crimes with Beasley, who hasn't been charged in the Craigslist case.

Rafferty made his first public court appearance in the case Tuesday, appearing dazed as a judge postponed a hearing on whether he should be tried as an adult. He didn't speak during the hearing. His mother, Yvette Rafferty, said she was "praying for the families and the victims."

Beasley walked into court Thursday but later complained that he felt ill, and he was wheeled by deputies before the judge. He ignored reporters' questions outside court on whether there are more buried bodies and about his relationship with Rafferty.

His attorney, Rhonda Kotnik, said later that Beasley's mother is worried that he has displayed symptoms of a stroke. Beasley is taking medication for back pain, Kotnik said.

His emotional state "is distraught. He's alert, he's in pain because of his issues, his back issues," she said.

Kotnik said earlier this week that Texas had wanted Beasley held regardless of his circumstances.

"They said we don't want to waste our gas to come down there if he hasn't been convicted of anything," she said Tuesday. "So Texas wanted him held, but you can't do that, you can't hold somebody indefinitely in a jail if they post bond."

Beasley, in a four-page handwritten letter to the Akron Beacon Journal, said he has been miscast as a con man when he had helped feed, house and counsel scores of needy families, drunks, drug addicts, the mentally ill and crime suspects for years.

"To call me a con man when I sacrificed for others is wrong," wrote Beasley, who didn't mention the Craigslist investigation or Rafferty. "To turn their back on me is not following Christ's example. I gave three full years of my life to that ministry and what I got out of it was the satisfaction of doing the right thing. There was no 'con' to it."

The bond revocation in the drug case for failing to appear for a Sept. 6 trial and the $1 million bond in the prostitution case allow authorities to hold Beasley as the Craigslist investigation continues.

A 15-count count indictment returned Wednesday charges Beasley with promoting prostitution and, in the case of a 17-year-old boy, compelling prostitution. The teen's involvement occurred from early November 2009 through late December 2010, the indictment said.

Kotnik said Beasley would fight the drug charge. He claims he was entrapped by an informant who was involved in a drug deal.
